2.3 Technical Data: IP addresses, device identifiers, operating system, browser type, location approximations.
2.4 Submitted Content: All text, media, assignments, messages, and files uploaded.
2.5 Cookies & Tracking: Persistent cookies, scripts, pixel tags, analytics, telemetry systems, and other automated monitoring technologies.

3. Cookies, Analytics & Tracking Systems

3.1 Use: For personalization, analytics, marketing, security, and operational improvements.
3.2 Retention: Cookies and tracking data may persist indefinitely.
3.3 Third-Party Integration: Includes Google Analytics, advertising networks, and partner services.
3.4 User Consent: Continued use constitutes consent to all tracking mechanisms.

4. Data Usage, Licensing & Sub-License Rights

4.1 Perpetual License: All submitted content grants ShipKunja an irrevocable, worldwide, royalty-free license to use, store, modify, analyze, publish, distribute, create derivative works, and monetize.
4.2 Transferability: License rights are transferable and sublicensable to affiliates, partners, or service providers.
4.3 Commercial Use: ShipKunja may use data for research, marketing, commercial, or operational purposes without limitation.
4.4 Sub-Clause: Users waive moral rights to submitted content where permitted by law.

5. Data Retention & Archival

5.1 Indefinite Storage: Data may be retained in primary storage, backups, or distributed systems indefinitely.
5.2 Account Closure: Retention persists beyond account termination or inactivity.
5.3 Legal Exceptions: Mandatory law may override retention policies in specific jurisdictions.
5.4 Sub-Clause: Users are responsible for maintaining personal backups.

6. Sharing, Disclosure & Third-Party Rights

6.1 Disclosure: Aggregated or anonymized data may be shared, sold, or licensed to third parties.
6.2 Legal Compliance: Personal data may be disclosed to authorities where required.
6.3 Third-Party Integration: ShipKunja is not responsible for third-party breaches, failures, or misuse of shared data.
6.4 Sub-Clause: Users acknowledge potential exposure of data through integrations.

7. User Conduct & Sub-Clauses

7.1 Prohibited Conduct: Harassment, disruption, exploitation, hacking, circumvention, scraping, reverse engineering, and illegal activity.
7.2 Content Restrictions: No submission of harmful, illegal, defamatory, or infringing content.
7.3 Automated Systems: Unauthorized automation or bot usage is prohibited.
7.4 Sub-Clause: Violation may result in immediate account termination, legal action, and indemnification.

8. Payments, Refunds & Sub-Clauses

8.1 Payment Obligation: All fees must be paid before service activation.
8.2 Refund Policy: Refunds are at ShipKunja’s sole discretion.
8.3 Penalties: Unpaid balances may incur collection procedures.
8.4 Sub-Clause: Digital products or services delivered are considered consumed and non-returnable.

9. Termination, Suspension & Enforcement

9.1 Termination Rights: ShipKunja may suspend or terminate services at any time.
9.2 Content Removal: ShipKunja may remove any submitted content without notice.
9.3 Legal Remedies: Termination does not waive any legal rights or remedies.
9.4 Sub-Clause: ShipKunja may enforce restrictions globally across platforms.

10. Indemnity & Liability

10.1 User Indemnification: Users agree to indemnify ShipKunja against claims, liabilities, and losses.
10.2 Liability Limitation: All indirect, incidental, punitive, or consequential damages are disclaimed. Total liability capped at payments made in the prior 12 months.
10.3 Sub-Clause: Users acknowledge risks inherent in digital services.

11. Amendments, Updates & Forced Acceptance

11.1 ShipKunja reserves the right to modify, add, remove, or replace any clause at any time.
11.2 Users are deemed to accept all changes by continuing to use services.
11.3 Sub-Clause: Ignorance of updates does not excuse compliance.

12. Governing Law, Arbitration & Jurisdiction

12.1 Applicable Law: Nepal law governs these Terms.
12.2 Arbitration: Binding arbitration in Kathmandu required for disputes.
12.3 Waiver: Users waive class actions and collective proceedings.
12.4 Sub-Clause: Arbitration decisions are final and enforceable globally.

13. Intellectual Property, DMCA & Ownership

13.1 Ownership: All materials, trademarks, software, and content are ShipKunja property.
13.2 DMCA: ShipKunja may remove infringing content and cooperate with rights holders.
13.3 Sub-Clause: Users waive moral rights to submitted content where legally permissible.

14. No Expectation of Privacy

14.1 Monitoring: All communications, submissions, and activity may be monitored and recorded.
14.2 Sub-Clause: Users acknowledge that ShipKunja may analyse, store, and act upon all user activity.

15. Automated Systems & AI

15.1 Use of AI: Automated systems may control access, grading, scoring, and recommendations.
15.2 Sub-Clause: Users accept automated decision-making outcomes.

16. Service Availability & Operational Control

16.1 Uptime: No guarantee of uninterrupted access.
16.2 Maintenance: Services may be temporarily restricted for updates or security.
16.3 Sub-Clause: ShipKunja bears no liability for downtime or lost opportunities.

17. Third-Party Services & Integrations

17.1 Responsibility: Users acknowledge risks with third-party services.
17.2 Sub-Clause: ShipKunja disclaims liability for third-party breaches or misuse.

18. Security Responsibilities & Risk Acceptance

18.1 Account Security: Users must protect credentials.
18.2 Risk Acceptance: Users acknowledge risks including data loss, cyber threats, or service interruptions.
18.3 Sub-Clause: Users must maintain personal backups.

19. Content Submission & Academic Integrity

19.1 Submission Rules: No illegal, plagiarized, or harmful content.
19.2 Academic Integrity: No cheating, impersonation, or unauthorized collaboration.
19.3 Sub-Clause: Violations may result in termination, certificate revocation, and legal action.

20. API, Automation & Scraping Restrictions

20.1 Unauthorized automation, scraping, or API usage is prohibited.
20.2 Sub-Clause: Violations may result in account termination, legal action, or IP blocking.

21. Severability & Entire Agreement

21.1 Severability: Invalid clauses do not affect remaining Terms.
21.2 Entire Agreement: This document represents the full agreement between users and ShipKunja.
21.3 Sub-Clause: Prior communications are nullified unless expressly referenced.
